What mandatory information must a rental property inventory include?+
Type of inventory (move-in/move-out), date, property location, names of parties, meter readings (water, gas, electricity), details of keys handed over, precise description of each room (floors, walls, ceilings, fixtures) with condition noted (good condition, normal wear, damage).
What is the difference between wear and tear and damage?+
Wear and tear is normal deterioration due to time and normal use of the property. It cannot be charged to the tenant. Damage is harm caused by the tenant beyond normal use. A depreciation schedule defines the theoretical lifespan and annual depreciation rate of each element.
Can the tenant contest a property inventory?+
Yes. In many jurisdictions, the tenant has a period after signing to request modifications to the move-in inventory. In case of persistent disagreement, mediation or a judicial officer can be called upon (shared costs). It is recommended to take dated photos as evidence.
What lighting is required for a property inventory?+
The property inventory must be carried out under adequate lighting conditions, sufficient to observe the condition of surfaces and fixtures. In practice, this means natural light or functional artificial lighting. An inventory conducted without sufficient lighting can be contested. Electricity must be connected at the time of the inspection.
What deductions are permitted from the security deposit?+
The landlord typically has 1 month (if inventories match) or 2 months (if differences are found) to return the security deposit. Deductions must be justified by quotes or invoices corresponding to damage identified by comparing the move-in and move-out inventories, minus depreciation for wear and tear.
