What is the difference between an insurance expert and a policyholder's expert?+
The insurance expert is appointed (and paid) by the insurance company to assess damages. The policyholder's expert is appointed by the insured party to defend their interests and contest the insurer's assessment if necessary. The policyholder's expert is paid by the insured (free fees, often a percentage of the indemnity). Both have access to the same information. A policyholder's expert is particularly useful for major claims.
How is depreciation calculated in a claim?+
Depreciation is the decrease in value of an asset due to wear and time. The expert applies a depreciation coefficient (% per year) according to schedules: furniture 10%/year, appliances 10-15%/year, roofing 2-3%/year, plumbing 3-4%/year. Compensation = replacement value - depreciation. Some 'new for old' policies limit or eliminate depreciation (for an additional premium). Depreciation buyback (supplement paid after repairs) is common in home insurance policies.
What is the ten-year warranty in construction claims?+
The ten-year warranty (article 1792 of the Civil Code) covers for 10 years damages compromising the structural integrity of the work or making it unfit for its intended purpose. The owner's building damage insurance (DO) pre-finances repairs without waiting for liability determination. The DO insurer then seeks recovery against the builder's ten-year insurer. DO declaration deadline: 5 years for visible defects.
What claims are covered by natural disaster declarations?+
Natural disaster status is declared by inter-ministerial decree published in the Official Journal (article L.125-1 of the Insurance Code). Covered events: floods, mudslides, drought (clay shrink-swell), earthquakes, avalanches, marine submersion. Legal deductible: 380 euros for housing, 10% of damage amount for professionals (minimum 1,140 euros). The deductible is increased in the absence of a Risk Prevention Plan (PPR).
What is the compensation timeline after a claim?+
The insurer has: 30 days after the amicable agreement to pay the indemnity (simple claim), 3 months after the claim date to propose a compensation offer (natural disaster, article A.125-1). For theft: compensation 30 days after agreement. If items are not returned within 30 days, the final compensation is paid. The insurer may pay a provisional payment (advance) for urgent repairs. In case of delay: late interest at the increased legal rate.
