What are the claim declaration deadlines?+
Yes. The policyholder can request a counter-assessment by appointing their own expert (at their own cost, often 5-10% of the compensation obtained). If persistent disagreement between the two experts, a third-party assessment is organized (expert chosen jointly or by the court). The policyholder can also contact the insurance mediator (free) or the judicial court. Limitation period: 2 years from the claim (article L.114-1 of the Insurance Code).
How does an insurance assessment work?+
The insurer appoints an expert (theoretically independent). The expert summons the policyholder, visits the premises, assesses the damage (minus depreciation), and writes a report. The policyholder can contest by appointing their own expert (counter-assessment). In case of disagreement: adversarial assessment, then potentially third-party assessment (deciding expert). For claims under 1,600 euros, the insurer often proceeds without assessment (mutual agreement on supporting documents).
What is the IRSI convention for water damage?+
The IRSI convention (Building Claim Indemnification and Recovery, effective June 1, 2018) simplifies management of water damage and fire between insurers. For claims under 1,600 euros excl. VAT: the insurer of the affected premises occupant handles alone. Between 1,600 and 5,000 euros: the insurer appoints a joint expert. Above 5,000 euros: standard procedure with recovery between insurers. The convention speeds up policyholder compensation.
What evidence should be provided for an insurance claim?+
Photos datées des dommages (avant toute remise en état), factures d'achat ou justificatifs de valeur des biens endommagés, devis de réparation (au moins 2 si possible), constat amiable de dégât des eaux (si applicable), dépôt de plainte (vol/vandalisme), attestation d'entretien (chaudière, ramonage), rapport de l'artisan intervenu en urgence. L'assuré doit prendre les mesures conservatoires pour limiter l'aggravation des dommages.
Can an insurance assessment report be contested?+
Oui. L'assuré peut demander une contre-expertise en mandatant son propre expert d'assuré (frais à sa charge, souvent 5-10% de l'indemnité obtenue). Si désaccord persistant entre les deux experts, une tierce expertise est organisée (expert choisi conjointement ou par le tribunal). L'assuré peut aussi saisir le médiateur de l'assurance (gratuit) ou le tribunal judiciaire. Délai de prescription : 2 ans à compter du sinistre (article L.114-1 du Code des assurances).
